Linguistic Differences Between Legal and Medical Translation

Abstract: All technical translation, defined here as non-literary translation, requires the translator to have some knowledge of the subject area being translated. Assuming that the translator has this basic knowledge of the area, not all areas are created equally. In this article I discuss a difficulty particular to medical translation, namely register, and the problems it entails. I then discuss legal translation and the complications caused due to lack of equivalence between the underlying legal systems of the source and target languages.

Uma análise qualitativa de marcadores culturais em dois corpora paralelos de traduções jurídicas de direito privado de português para inglês e de inglês para português

Resumo: Esta tese apresenta uma análise qualitativa da tradução de marcadores culturais referenciais (extra-lingüísticos) e estilísticos (convenções lingüísticas) em dois corpora paralelos de documentos da área de direito privado, um com originais em português brasileiro e traduções em inglês e o outro com originais em inglês e traduções em português brasileiro. Os corpora não contêm traduções de aprendizes. Dividiu-se os marcadores em categorias temáticas para identificar tendências de abordagem. As análises incluíram classificação das soluções tradutórias através das modalidades de Aubert (2005), com modificações, e graus de aproximação do receptor ao texto original. Dois corpora comparáveis em inglês e português também foram coletados e utilizados para servir como uma referência para questões estilísticas.

Abstract: This dissertation is a qualitative analysis of the translation of referential (extra-linguistic) and stylistic cultural markers in two parallel corpora containing documents from the area of private law, one with originals in Brazilian Portuguese and translations in English and the other with originals in English and translations in Brazilian Portuguese. The corpora contain translations performed by professionals, not students of translation. The cultural markers were categorized thematically to permit identification of translation strategy trends. The analyses included classification of translation solutions using the modalities of Aubert (2005), with modifications, and degrees of approximation between the receptor and the original text. Two comparable corpora in English and Brazilian Portuguese were also compiled and used as a reference for stylistic questions.

A tradução jurídica como praticada atualmente: um estudo de corpus

Resumo: Na tradução jurídica, é necessário achar um equilíbrio entre a tradução do conteúdo e o uso de terminologia e fraseologia do idioma/universo jurídico da língua e país de tradução. Até que ponto a tradução precisa exibir sua alteridade? Corpora paralelos e comparáveis de contratos e procurações foram analisados para ver como este equilíbrio é estabelecido por uma variedade de tradutorse jurídicos. Aspectos de interesse incluem a tradução de conceitos com e sem equivalentes no outro universo jurídico, e a tradução de frases inteiras por frases de uso equivalente mas não de sentido equivalente.

How to Use Linguistic Corpora to Improve Your Translations

Abstract: The use of corpora is one of the best ways for translators to improve their translations on their own. A corpus is a collection of texts either with or without their corresponding translations. I will describe the types of data extracted from corpora, how you can create your own or use ready-made corpora, or take advantage of the corpora built automatically by translation memory tools like DéjàVu, Trados and SDLX while you work. Corpora are perfect for the translator studying a new source language, working in a new sub-area (law, medicine, etc.) or out of their mother tongue, but we all can learn from them.
